Arm alleges that Qualcomm improperly obtained its instruction set license through its acquisition of NUVIALawsuit, the U.S. court earlierRulingQualcomm's authorization is valid and it believes its actions are legitimate.
Arm has stated that it will continue to appeal, but the current court ruling favors Qualcomm. Unless Arm can find further evidence to convince the court, it may face defeat. This may also lead to more companies following Qualcomm's approach to obtain Arm instruction set licenses rather than reapplying for licenses from Arm.
The court's ruling mainly determined that Qualcomm acquired NUVIA in order to obtain its independent architecture design capabilities, but it continued to pay instruction set licensing fees to Arm, so it did not violate the licensing method.
In addition, the judge who heard the case, Maryellen Noreika, called on Arm and Qualcomm to negotiate, believing that further debate through appeal would not change the relevant results.
