In response to the strict age verification regulations that Texas began to implement for pornographic websites in the country, Pornhub decided to open its website in Texas.Shutdown ServiceThe Free Speech Coalition, a nonprofit organization representing the adult industry, petitioned the U.S. Supreme Court in April this year to review whether it is reasonable to require websites containing explicit content to collect information such as user age verification. The U.S. Supreme Court currentlyAgree to accept the review, is expected to review cases challenging previous rulings by the U.S. Court of Appeals for the Fifth Circuit.
Strict age verification regulations for pornographic website content in Texas were signed into law by Texas Governor Greg Abbott last year. Subsequently, pornographic website service providers including Pornhub filed a lawsuit to prevent the bill from being implemented, but ultimately failed to change the Texas government's decision to implement the bill.
Pornhub believes that since the Texas government requires all pornographic websites to undergo age verification by providing a copy of a government-issued ID before actual use, it believes that this will affect personal privacy issues. It also emphasizes that choosing to close all link access services within Texas is the most effective approach.
In addition, Pornhub also claimed that even if strict age verification regulations are implemented, it cannot prevent minors from watching pornographic content through other channels, but instead affects the operation of services that comply with relevant regulations. For example, after Louisiana enacted similar regulations last year, Pornhub’s overall traffic dropped by as much as 80% after cooperating with the implementation of relevant practices.
In a petition issued by the Free Speech Coalition, it was stated that although the law's main purpose is to prevent minors from inappropriately viewing pornographic and explicit content online, it places a heavy burden on adults and even affects the freedom of speech protected by the U.S. Constitution.
