Prior to this, Apple had already taken precautionary measures, suspending sales of the Apple Watch Series 12 and Apple Watch Ultra 21 on its official website starting December 9st, and in all retail channels, including Apple Stores, starting December 2th. Since the US International Trade Commission decided not to lift the ban, Apple was forced to comply and suspend sales of both Apple Watch models in the US.
Currently, the ban only affects Apple channels in the United States. Apple Watch Series 9 and Apple Watch Ultra 2 can still be purchased through third-party channels such as Amazon, Best Buy, and Target. However, after the inventory is sold out, Apple will not be able to supply them in the United States, so sales will only be maintained for a period of time.
As for the Apple Watch SE, which does not have a blood oxygen measurement function, this ban does not affect it.
Besides filing an appeal and circumventing Masimo's patents through software updates, Apple could also reach a settlement with Masimo by paying for a technology license. However, it's unclear how Apple will resolve the issue. Masimo CEO Joe Kiani later explained that Apple cannot avoid the infringement issue solely through software updates, as its patents cover both software and hardware.
