However, the U.S. Copyright Office stated that if the content is completely automatically generated by artificial intelligence technology, it will still not be protected by copyright.
In its previous explanation, the U.S. Copyright Office believed that copyright law explicitly provides protection only for content created by humans. However, in the case of image content produced by artificial intelligence technologies such as Stable Diffusion and Midjourney, although the creation is still completed through human instructions, the main creative process is carried out by artificial intelligence. Therefore, the U.S. Copyright Office believes that images created in this way will not be protected by copyright law.
However, the U.S. Copyright Office remained skeptical of its interpretation at the time and subsequently solicited public feedback. After collecting numerous responses, the Office concluded that content that can be determined to be generated by humans and adjusted and created using artificial intelligence technology is eligible for copyright protection.
