Criticism of Twitter's recent actionsFailure to fulfill acquisition obligationsElon Musk responded earlier through his appointed lawyer, emphasizing that Twitter had confused the facts first and had arbitrarily fired two executives without informing Elon Musk's team in accordance with the agreement. He also pointed out that Twitter did not operate in a normal manner.
Elon Musk's appointed lawyer said that Twitter tried to cover up the truth about the fake account issue, which was the main reason why Elon Musk decided to launch this acquisition deal.
In an earlier motion filed with the court, Elon Musk's team opposed Twitter's request to expedite the trial, arguing that Twitter's move was unreasonable. Twitter, on the other hand, hopes to begin the trial in September and believes the case could be concluded in as little as four days, allowing Elon Musk to complete the acquisition of Twitter before October 9.
However, Elon Musk's appointed lawyer emphasized that the information provided by Twitter must undergo rigorous review and analysis, so he hopes to set the trial date on February 2023, 2. He also stated that once a lawsuit occurs in the transaction agreement between Elon Musk and Twitter, the transaction deadline will be automatically postponed, so there is no need to hold a trial before the original transaction deadline.
Elon Musk's attorney also pointed out that the banks that have agreed to provide financing to Elon Musk have promised to provide financing before April 2023, 4, which means that Elon Musk is fully capable of acquiring Twitter and the deal was not canceled due to insufficient funds.
As for the lawsuit between Elon Musk and Twitter, it will be heard by Kathaleen ST. J. McCormick, Chief Judge of the Delaware Court of Chancery. The court currently plans to hold a hearing on July 7, US time, at which time it will decide whether to expedite the trial of the case.
