According to Judge Yvonne Gonzalez Rogers who made the ruling, since Epic Games violated the App Store regulations first, Apple has the right to remove "Fortnite" from the App Store on the grounds of violating the usage regulations.
However, in the relevant ruling, Yvonne Gonzalez Rogers emphasized that both Epic Games and Apple have the right to file lawsuits against each other to protect their own interests, but the rights of other developers should not be implicated. Therefore, in the relevant ruling, the court ruled that Apple cannot terminate Epic Games' developer account rights due to Epic Games' violation of the terms of use, thereby affecting the rights of other developers who use the Unreal Engine to create content.
However, the current ruling is mainly based on the preliminary conclusions of both parties at this stage.
